Over the past ten years, various legal structures suitable for wealth planning and management have been developed in Central Europe, gaining increasing popularity not only within the region but also internationally. Art pieces and art collections in the trust   

In the context of managing private wealth, the management of art pieces, especially large collections, is gaining increasing attention worldwide due to its unique characteristics. Since these are specialized assets compared to other types of property, it is important to assess the knowledge, requirements, and techniques necessary for their management. These objects can represent immense value, but their proper management can incur significant costs. Without aiming for completeness, a well-prepared wealth manager must ensure proper cataloguing and archiving, storage, warehousing, transportation, insurance, development of utilization methods, creation of sales and purchasing policies, and last but not least, establishing cooperation with public collections. All of this requires complex knowledge, which is only partially regulated by law. This panel discussion aims to review and organize this set of tasks.

Trustees’ and Directors’ Liability – is it a risky business  

The liability regime of a trustee in the case of trust of directors in the case of a foundation is complex, as they may be liable to the settlor, to the beneficiaries and to third parties as well. In some cases, they are liable with the assets they manage, while in other cases they are liable with their own assets. Furthermore, the task of anti-money laundering is also assigned by the states to the trustees. It is in the trustee’s and director’s interest to limit its liability as much as possible, but this may hinder the trust of the settlors and the beneficiaries. Limiting the liability may also damage the trust’s integrity, and give potential weapons to third party creditors. Navigating these conflicting interests require skilled professionals, who can view such cases objectively. In this panel discussion the speakers will discuss and explore these thought-provoking topics.
